Definitions

What is personal data?

Personal data is any information relating to an identified or identifiable natural person. This includes, for example, name, address, date of birth, email address, or phone number, as well as IP address. Data on personal preferences such as hobbies or memberships also count as personal data.

What are special categories of personal data?

Special categories of personal data (also referred to as “particularly sensitive data”) include:

• Data on religious, philosophical, political, or trade union views or activities
• Data on health, intimate life, racial or ethnic origin, sexual life, and sexual orientation
• Data on administrative or criminal proceedings and sanctions, as well as social assistance measures
• Genetic and biometric data that uniquely identify a person

Where necessary and where you disclose such data to us yourself, we may process data belonging to a special category of personal data. In this case, its processing is subject to stricter confidentiality.

What is “processing” personal data?

Processing is any handling of personal data, regardless of the means and methods used — in particular collecting, storing, retaining, using, altering, disclosing, archiving, deleting, or destroying personal data.

What is “disclosure” of personal data?

This is the transmission or making accessible of personal data, e.g. publication or disclosure to a third party.

Data Security

We store your data securely and take all reasonable measures to protect it from loss, unauthorized access, misuse, or alteration.

Our contractors and employees who have access to your data are obligated to comply with data protection regulations. In some cases, as part of order processing, it may be necessary for us to forward your requests to affiliated companies. In these cases too, your data will be treated confidentially.

Within our website, we use the SSL (Secure Socket Layer) protocol together with the highest encryption level supported by your browser.

Rights of Data Subjects

Right of Access

You may request information about the data we hold about you at any time. Please send your request for information together with credible proof of identity to benji@allorganicmedia.co.

Information will be provided in writing or in another form, including electronically where applicable. If you request it, we can also provide the information verbally, provided you prove your identity in another form. If you submit the request electronically, we will provide the information in a common electronic format unless you specify otherwise.

Information is generally provided free of charge. If copies are requested beyond this, a reasonable fee may be charged.

The right to receive a copy of the processed data must not adversely affect the rights and freedoms of others.

In the case of manifestly unfounded or excessive requests, we reserve the right to refuse the request within the limits of the law or to charge a reasonable fee.

Processing of your request is subject to a statutory deadline of 30 days. This period may be extended by a further two months due to complexity or a high volume of requests, if necessary. You will be informed of any extension within one month of submitting your request, along with the reasons for the extension.

Deletion and Correction

You may at any time request the deletion or correction/completion of your data, provided there are no statutory retention obligations or legal grounds preventing this.

Please note that exercising your rights may, in certain circumstances, conflict with contractual agreements and may have corresponding consequences for the performance of the contract (e.g. early termination or cost implications).

Restriction of Processing

You also have the right to request a restriction of processing if you dispute the accuracy of the data, if the processing is unlawful, if the data is no longer needed, or if you have objected to the processing.

If processing is restricted, the data may only be stored. Further processing may only take place with your consent, to assert, exercise, or defend legal claims, to protect the rights of another person, or for reasons of important public interest. You will be notified if the restriction is lifted.

Right to Data Portability

You have the right to receive your data in a common file format, or (if technically feasible) to have it transmitted to a third party, where we process your data automatically and where:

• you have given your consent to the processing of this data; or
• you have disclosed data in connection with the conclusion or performance of a contract.

Right to Object

You have the right, for reasons arising from your particular situation, to object at any time to processing (including profiling) carried out on the basis of our legitimate interests. This right also applies to processing for direct marketing purposes.

Legal Recourse

If you are affected by the processing of personal data, you have the right to enforce your rights in court or to file a complaint with the competent supervisory authority. The competent supervisory authority in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC).

General Data Processing

What data do we process, and from whom do we receive it?
We primarily process personal data that you provide to us or that we collect while operating our website. In some cases, we may also receive personal data about you from third parties. This may include the following categories:

• Basic personal data (name, address, date of birth, etc.)
• Contact data (phone number, email address, etc.)
• Financial data (e.g. account details)
• Online identifiers (e.g. cookie identifiers, IP addresses)

This data may originate from the following sources:

• Publicly available sources (e.g. media, internet)
• Public registers (e.g. commercial register, debt collection register, land register)
• Information related to administrative or judicial proceedings
• Information about your professional roles and activities (e.g. professional networks)
• Information about you from correspondence and discussions with third parties
• Credit information (where we conduct personal transactions with you)
• Information about you provided by people in your environment, to enable us to enter into or perform contracts with you
• Data related to the use of the website

Under what conditions do we process your data?
We process your data in good faith and for the purposes set out in this privacy policy. We aim for transparent and proportionate processing.

Should we exceptionally be unable to comply with these principles, the data processing may still be lawful because a justification applies. Justifications include in particular:

• your consent;
• the performance of a contract or pre-contractual measures;
• compliance with statutory provisions;
• our legitimate interests, provided your interests do not outweigh them.

In some circumstances, you are required to disclose certain personal data to us so that we can enter into a business relationship. Without such data, we are normally unable to perform a contract. Likewise, the website generally cannot be used if certain information required to ensure data transmission, such as your IP address, is not disclosed.

How can you withdraw consent you have given?
If you have given us consent to process your personal data for specific purposes, we process your data within the scope of that consent, provided we do not have another legal basis or another permitted ground applies.

You can withdraw your consent for the future at any time by sending an email to the address listed in the Legal Notice. Any processing already carried out is not affected by the withdrawal and remains valid.

In which cases do we disclose your data to third parties?

a. General
We may rely on the services of third parties or affiliated companies and engage them to process your data (so-called processors). Categories of recipients include in particular:

• Accounting, fiduciary, and audit firms
• Consulting firms (legal advice, tax, etc.)
• IT service providers (web hosting, support, cloud services, website design, etc.)
• Payment service providers (only with your prior consent)
• Providers of tracking, conversion, and advertising services

We ensure that data is only disclosed with your express consent, unless it concerns order processing. We further ensure that these third parties and our affiliated companies comply with data protection requirements and treat your personal data confidentially. In certain circumstances, we may also be required to disclose your personal data to authorities.

b. Disclosure to Partners and Cooperation Partners
We sometimes work with various companies and partners who display their offers on our website. It will be recognizable to you that this is a third-party offer (marked as “advertising”).

If you make use of such an offer, we transmit your personal data to the relevant partner or cooperation company (e.g. name, role, communication, etc.) whose offer you wish to use, provided you have previously given express consent. These partners and cooperation companies are independently responsible for the personal data they receive. Following transmission, the privacy provisions of the respective partner apply.

c. Disclosure Abroad
In the context of order processing, your personal data may be transmitted to companies abroad. These companies are subject to the same level of data protection obligations as we are. Transmission may take place worldwide.

If the level of data protection does not correspond to that of Switzerland, we carry out a prior risk assessment and contractually ensure that the same level of protection as in Switzerland is guaranteed (e.g. by means of the European Commission’s standard contractual clauses or other legally required measures). Should our risk assessment be negative, we take additional technical measures to protect your data. You can access the European Commission’s standard contractual clauses via the following link.

How long do we retain your data?
We store personal data only for as long as necessary to fulfill the specific purposes for which the data was collected. We retain contractual data for longer, as we are legally required to do so. In particular, we must retain business correspondence, concluded contracts, and booking records for up to 10 years. Once we no longer need such data to perform our services, the data is restricted for further processing and used only for accounting and tax purposes.

Individual Data Processing Activities

Providing the Website and Creating Log Files
When you simply visit www.allorganicmedia.co — that is, without registering or providing any other information — only the data your browser automatically transmits to our server is collected. This data is technically required to operate the website.

What data do we process?
When providing the website and creating log files, we process in particular the following data:

• Name of the internet service provider
• IP address

Log files are processed to ensure the functionality of the website and to safeguard the security of our IT systems.

To whom do we disclose this data?
Disclosure of this data follows our general remarks on data disclosure above.

How can you prevent this processing?
Data is stored only as long as necessary to fulfil the purpose of its collection. Accordingly, it is deleted at the end of each session. Storing log files is technically necessary to operate the website, so you have no way to object to this other than by not visiting our website.

Contact
You can contact us in several ways. If you contact us and provide personal data, we will process it. This includes any verbal, written, or other form of contacting us.

What data do we process?
When you contact us, we process all data you provide to us. This includes in particular:

• Name

• Contact details

In some cases, you may be required to provide certain data in order to contact us, for example via a contact form or when requesting a callback.

For what purpose do we process this data?
The purpose for which we use the data depends on the nature of the contact. We never use the data for unforeseeable or unexpected purposes. The most common purposes are communication and response, customer service, and handling business inquiries.

To whom do we disclose this data?
Disclosure of this data follows our general remarks on data disclosure above. If the purpose of your contact requires disclosure of your data to third parties, we disclose the data to the extent necessary.

How can you prevent this processing?
If you contact us, this processing cannot be prevented. Accordingly, you must refrain from contacting us if you do not want your data to be processed.

Cookies
Our website uses cookies. Cookies are text files that are stored on your device’s operating system via your browser when you visit our website. Cookies do not damage your device and do not contain viruses. Some cookies are technically necessary for the website to function. Most of the cookies we use are so-called “session cookies.” They are automatically deleted after your visit ends. Other cookies remain stored on your device until you delete them or their validity expires.

For what purpose do we process this data?
We use cookies so that, based on the data collected, we can make our website more user-friendly, effective, and secure. In particular, we use cookies to store your preferences (e.g. language and location settings), to deliver and present website content attractively and quickly (e.g. through the use of fonts and content delivery networks), and to analyze the use of this website for statistical evaluation and continuous improvement (generally via third-party cookies). The specific purposes for which we use non-essential cookies are set out in the sections below.

To whom do we disclose this data?
Disclosure of this data follows our general remarks on data disclosure above. Please also refer to the sections below on individual data processing activities in this privacy policy.

How can you prevent this processing?
Cookies are stored on your device. You can delete them entirely or restrict/deactivate their transmission by changing your browser settings. If you deactivate cookies for our website, not all functions of the website may remain fully usable.

Newsletter with Performance and Reach Measurement
Through our website, you have the option to subscribe to our newsletter. With the newsletter, you receive information about new posts, events, and offers. We collect performance and reach measurement data through our newsletter.

What data do we process?
To send the newsletter and carry out performance and reach measurement, we process in particular:

• IP address
• Contact data
• Date and time of subscription
• Technical information such as browser, operating system, or screen resolution
• Interactions with the newsletter

The IP address is generally anonymized so that it can no longer be attributed to a specific person.

For what purpose do we process this data?
We use the collected data to send the newsletter, for verification, and for personalized salutation. We store your data — particularly the IP address used at the time of subscription and the date and time — to log the subscription and to detect misuse. This data is stored for the duration of your newsletter subscription. We also use the IP address to determine your approximate location. From this information, we can measure the relevance of our offers in different regions and segment advertising campaigns. Technical information is used to ensure the newsletter displays correctly on every device. Interactions, time, and date are collected so that we can evaluate and optimize our marketing campaigns and offers based on this data, and to determine how subscribers interact with our newsletter.

To whom do we disclose this data?
We disclose your data to service providers commissioned with the technical handling and the performance and reach measurement of the newsletter. These service providers may have servers located around the world. It is therefore possible that the collected data may be transmitted worldwide by our service providers. Our general remarks on data disclosure also apply.

How can you prevent this processing?
You can unsubscribe from the newsletter at any time by clicking the unsubscribe link in an email you received from us. Alternatively, you can unsubscribe by sending us an email.

Comments
You have the option to comment on certain content on our website.

What data do we process?
To publish a comment, you must provide us with the following information:

• Content of the comment
• Name
• Email address (not published)

For what purpose do we process this data?
The content of the comment must be collected for the comment to be possible at all. The name is collected so a comment can be attributed to a specific user. If you do not want your name published, we ask that you use an alias. We use your email address for verification, to notify you of responses to your comment, or to contact you if a third party reports your comment as unlawful. To prevent unauthorized use of email addresses and ensure the security of your data, we use a double opt-in procedure — meaning you receive an email in which you must confirm that you are the owner of that email address and wish to receive notifications. You can unsubscribe from notifications at any time by clicking the link included in the email. Your personal data, including email address, the time of your registration for the service, and your IP address, are stored by us until you unsubscribe from the notification service.

To whom do we disclose this data?
Disclosure of this data follows our general remarks on data disclosure above.

How can you prevent this processing?
You can only prevent the collection of your data via the comment function by refraining from publishing a comment. If you wish to publish a comment, this processing cannot be prevented.

Tracking Pixels
We may use tracking pixels on our website or in our emails. Tracking pixels are also referred to as web beacons. These are small, typically invisible images that are automatically retrieved when you visit our website or open our emails.

What data do we process?
Tracking pixels can collect the same information as log files. In addition, movement profiles of the entire session may be collected. Tracking pixels are used in particular by third parties whose services we use. These third-party services are described individually below in this policy.

For what purpose do we process this data?
Tracking pixels are used by various tracking services to analyze the use of this website for statistical evaluation and continuous improvement. They may also be used for email tracking.

To whom do we disclose this data?
Disclosure of this data follows our general remarks on data disclosure above. Please also refer to the sections on individual tracking services in this privacy policy.

How can you prevent this processing?
To prevent data processing via tracking pixels, you can install suitable browser extensions such as uBlock Origin, and block external images in your email program.

Google Analytics
We use Google Analytics on our website, a service provided by Google Ireland Ltd., Google Building Gordon House, Barrow St, Dublin 4, Ireland, with its parent company Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (together “Google”).

What data do we process?
Google Analytics is a web analytics service used to collect information about the use of the website. In particular, the following information may be collected:

• IP address
• Technical information such as browser, operating system, or screen resolution
• Interactions on the website
• Duration of the visit
• Time and date of the website visit
• Referrer URL

The IP address is anonymized by Google Analytics so that it can no longer be attributed to a specific person. When a visitor visits our website for the first time, Google Analytics may generate an identifier to recognize the visitor on a return visit. If you are signed in with your Google account, data processing may also occur across devices.

For what purpose do we process this data?
Your IP address is used to determine your approximate location. From this information, we can measure the relevance of our offers in different regions. We also use the IP address to determine where website visitors came from. Technical information is processed so the website displays satisfactorily on every device. Interactions, duration, time, and date are collected so that we can evaluate and optimize our marketing campaigns and offers based on this data. This also allows us to determine how visitors interact with our website — i.e. which content is popular with which visitors. The referrer URL is processed to measure the effectiveness of, and analyze, various marketing channels.

To whom do we disclose this data?
Disclosure of this data follows our general remarks on data disclosure above. As Google is a multinational company, your data may be transmitted by Google worldwide. In particular, your data may be transmitted to the United States, where Google’s headquarters are located — a country whose legislation does not guarantee an adequate level of data protection.

Google Tag Manager
We use Google Tag Manager on our website, a service provided by Google Ireland Ltd., Google Building Gordon House, Barrow St, Dublin 4, Ireland, with its parent company Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (together “Google”).

Google Tag Manager is a service for centrally managing various tracking tags (e.g. Facebook Pixel, Google Analytics, Hotjar, etc.). Google Tag Manager itself does not collect any data. The individual tags that do collect data, and which we manage via Google Tag Manager, are described elsewhere in this privacy policy.

GoHighLevel (CRM & Marketing Automation)
We use GoHighLevel, a customer relationship management (CRM) and marketing automation platform provided by LeadConnector Inc. / HighLevel Inc., 800 N King Street, Suite 304 #3172, Wilmington, DE 19801, USA (“GoHighLevel”).

What data do we process?
When you book a call, submit a form, take our Retention Score assessment, or otherwise get in touch with us through the website, we process the data you provide via GoHighLevel, in particular:

• Name
• Email address
• Phone number
• Content and time of your submission or booking
• Communication history (e.g. appointment bookings, SMS, and email correspondence with us)

For what purpose do we process this data?
We use GoHighLevel to manage our customer relationships, to schedule and confirm appointments, to send you information you have requested (such as appointment reminders or the results of our Retention Score assessment), and, where you have given consent, to send you marketing communications.

To whom do we disclose this data?
Your data is processed by GoHighLevel as our order processor (Auftragsverarbeiter) on our behalf. GoHighLevel is based in the United States; data may therefore be transmitted to and processed in the United States, a country whose legislation does not guarantee an adequate level of data protection under Swiss law. Where required, we ensure an adequate level of protection through appropriate contractual safeguards (e.g. standard contractual clauses).

How can you prevent this processing?
You can withdraw any consent you have given (e.g. for marketing messages) at any time by replying “STOP” to an SMS, unsubscribing via the link in an email, or contacting us directly at benji@allorganicmedia.co.

Will This Privacy Policy Always Stay the Same?

We may change this privacy policy at any time. Changes will be published at www.allorganicmedia.co. You will not be notified separately.
